There is much to learn when it comes to doing an eviction in San Diego County. Most evictions require a notice to initiate the process and notices can range from a 3 day notice, 30 day notice, 60 day notice, or even a 90 day notice depending on the type of tenancy. Notices can be for non payment of rent, notice to quit for return of legal possession, and notice to quit for more severe issues such as code enforcement etc. Choosing which notice is very important because this is the backbone of your unlawful detainer (unlawful detainer is legalese for eviction) and if not done correctly, can waste your time and efforts causing lost time and...…..time is money. It is also very important to know you are getting the accurate form when seeking out a notice. Many notices offered online are outdated and do not contain all required wording needed. Once a court case number is assigned, your case then gets served on the tenant(s) and all unknown occupants. There will then be a 5-15 day waiting period to see if your tenant chooses to file a response at court. If they do file a response at court, a trial date will be set and then a sheriff lockout. If your tenant does not file a response within the given time frame, a default filing will occur and then the sheriff lockout process happens.
